Waivers

LIABILITY WAIVER

I understand and agree that I am voluntarily engaging in activities with Goodtime Bar Run Club [, a run club hosted by Goodtime Bar, a California S-Corporation located at 30 Fountain Alley #160, San Jose, CA 95113] (“GTBRC”). I understand and agree that organized group runs and other social events, runs, and races (collectively, “events”) organized by GTBRC are potentially hazardous activities which may cause injury or death. I will not participate in any GTBRC events unless I am medically able and properly trained. By participating in GTBRC events, I certify that I am in good health and have no medical or health condition that could endanger or limit my ability to participate in such events.

I agree to abide by all GTBRC event rules, policies and procedures and I hereby acknowledge that I have been provided with or been made aware of such rules, and policies and procedures. I understand and agree that any event rules, and policies and procedures may be changed by GTBRC with or without notice and GTBRC reserves the right to deny or terminate my participation in its events at any time for any reason, in GTBRC’s sole discretion.

I ASSUME ALL RISKS ASSOCIATED WITH ANY GTBRC EVENT INCLUDING, WITHOUT LIMITATION: FALLS; CONTACT WITH OTHER PARTICIPANTS; THE EFFECTS OF THE WEATHER, INCLUDING, WITHOUT LIMITATION, HIGH HEAT AND/OR HUMIDITY; TRAFFIC; SIGNAGE OR LACK THEREOF; ROAD OR PATH CONDITIONS; LOSS OR DAMAGE OF PERSONAL PROPERTY; AND ALL SUCH OTHER RISKS THAT MAY OCCUR IN THE COURSE OF MY PARTICIPATION IN GTBRC EVENTS. I HEREBY WAIVE, RELEASE, INDEMNIFY AND HOLD HARMLESS GTBRC AND ITS DIRECTORS, OFFICERS, SUB-CONTRACTORS, VOLUNTEERS, EMPLOYEES, AGENTS, MARKETERS, CLUB MEMBERS, DESIGNEES, SPONSORS AND THEIR REPRESENTATIVES FROM AND AGAINST ANY AND ALL CLAIMS, ACTIONS, DAMAGES, COSTS (INCLUDING ATTORNEYS’ FEES), EXPENSES, OR LIABILITIES ARISING OUT OF MY PARTICIPATION IN GTBRC EVENTS.

MEDIA RELEASE WAIVER

By participating in GTBRC events I agree to grant GTBRC permission to capture my image and likeness in photographs, videotapes, motion pictures, recordings, or any other media (collectively “images”). I understand and agree that GTBRC will own such images and irrevocably grant GTBRC the right to copyright, display, publish, distribute, use, modify, print and reprint such images in any manner whatsoever for the purpose of advertising, promotion, or any other commercial purpose in connection with GTBRC events and/or for other GTBRC promotional activities, including without limitation, on social media, marketing platforms, publications, promotions, advertisements, brochures, website images, or other electronic displays and transmissions thereof. I further waive any right to inspect or approve the use of the image by GTBRC prior to its use and waive any right to any profit GTBRC may obtain from the use of the aforementioned images. I forever release and hold GTBRC harmless from any and all liability arising out of the use of the images in any manner or media whatsoever, and waive any and all claims and causes of action relating to use of the images, including without limitation, claims for invasion of privacy or publicity.

This agreement shall be governed and construed in accordance with the laws of the State of California.
